| This is an Agreement between Red Rock Pet Resort and the pet owner (hereinafter called "Owner") whose signature appears below: 1. Owner agrees to pay the rate for pet care provided in effect on the date pet is checked into Red Rock Pet Resort. 2. Owner agrees to pay all costs and charges for special services requested and all veterinary costs for pet during the
arrangements are agreed upon by both parties. 4. Owner agrees that all checks are deposited the day they are received. A service charge of $25 will be assessed
not redeemed within one week. 5. Owner agrees to pay a $5.00 fee per pet to drop off pet(s) before normal operating hours. 6. Owner agrees to pay a $10.00 fee per pet to pick up pet(s) within the first half hour after normal operating hours and an additional $10.00 per pet for every half hour thereafter. 7. Cancellation Policy: Red Rock Pet Resort has a 24-hour cancellation policy for non-holiday boarding and a three (3) day cancellation policy for holiday boarding. Holidays shall be considered New Years Day, Memorial Day, Easter Sunday, July 4th, Labor Day, Thanksgiving, and Christmas Eve and Day. If you do not cancel your reservation in accordance with our cancellation policy, you will be charged 50% of the total reservation fee. A credit card number is required to book holiday reservations. Daycare cancellations with less than 24 hours notice will be charged full fees. Please understand that space in our facility is in high demand, and we must follow our cancellation policy. 8. By signing this Agreement and leaving pet with Red Rock Pet Resort, Owner certifies to the accuracy of all information given about said pet. Red Rock Pet Resort reserves the right to deny admittance to Owner's pet for any reason at any time. 9. Red Rock Pet Resort shall exercise reasonable care for the pet delivered by Owner to Red Rock Pet Resort. If interactive daycare is provided, Owner recognizes and accepts potential risks involved in such activity. It is expressly agreed by Owner and Red Rock Pet Resort that Red Rock Pet Resort's liability shall in no event exceed the lesser of the current chattel value of a pet of the same species per animal admitted. The Owner further agrees to be solely responsible for any and all acts of behavior of said pet while it is in the care of Red Rock Pet Resort, to include payment of costs for injury to staff or other animals or damage to facilities caused by the pet. 10. Owner specifically represents to Red Rock Pet Resort that, to the Owner's knowledge, pet has not been exposed to any contagious diseases within a thirty-day period prior to check-in. During the period of this Agreement, Owner also agrees to notify Red Rock Pet Resort of any known exposure of pet to a communicable disease and keep pet from attending Red Rock Pet Resort until pet is symptom- free for a minimum of 10 days or has veterinary clearance. Owner further agrees to maintain currency of vaccinations as required by Red Rock Pet Resort. 11. Owner specifically represents that he or she is the sole owner of pet, free and clear of all liens and encumbrances. 12. All charges incurred by Owner shall be payable upon pick-up of pet or when billed by Red Rock Pet Resort. Red Rock Pet Resort shall have, and is hereby granted, a lien on pet for any and all unpaid charges resulting from services provided by Red Rock Pet Resort. The Owner hereby agrees that in the event the charges are not paid when due in accordance with this contract, Red Rock Pet Resort may exercise its lien rights upon 10 days written notice given by Red Rock Pet Resort by certified mail to address shown on contract. Red Rock Pet Resort may dispose of pet for any and all unpaid charges, at private or public sale in the sole discretion of Red Rock Pet Resort, and Owner specifically waives all statutory or legal rights to the contrary. If such a sale shall not secure a price adequate to pay such costs of pet care or other charges delinquent, plus cost of sale, then Owner shall be liable to Red Rock Pet Resort for the difference. All monies realized by Red Rock Pet Resort at such sale, over and above the charges due, and costs of sale, shall be paid to Owner. 13. If pet becomes ill or is injured, or if the state of the animal's health otherwise requires professional attention, Red Rock Pet Resort, in its sole discretion, may engage the services of a veterinarian or administer medicine or give other requisite attention to the animal, and the expenses thereof shall be paid by Owner. 14. This Agreement contains the entire agreement between parties. All terms and conditions of this Agreement shall be binding on the heirs, administrators, personal representatives, and assigns of Owner and Red Rock Pet Resort. 15 Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, or as the result of any claim or controversy involving the alleged negligence by any party to this Agreement, shall be settled in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by an arbitrator may be entered in any Court having jurisdiction thereof. The arbitrator shall, as part of the award, determine an award to the prevailing party of the costs as such arbitration and reasonable attorney's fees of the prevailing party. |
